Question: If a father is 2-3 grand behind due to unemployment can the mother refuse to let the father see the child?
Answer: Under Arizona Domestic Relations Law, the obligation to pay child support and the right of a parent to have visitation with his or her children are separate obligations. A.R.S. Section 25-320 and Section 25-403.09 set out the rules and criteria for child support. A.R.S. 25-403.01 states that a non-custodial parent must be allowed reasonable visitation and parenting time. The Arizona courts have long held firm on the idea that the custodial parent cannot withhold visitation to a parent who is not paying child support.
