Child Support

questions & answers

Question: Both of my children have reached the age of eighteen and are not currently continuing their education. How do I get the state to discontinue taking child support payments out of my paycheck?

Answer:

The Child Support Payment Clearinghouse, or other agency collecting child support may realize that your children have reached the age of majority, and terminate the wage assignment on its own. However,  it is not a good idea to rely on that process to work without intervention from you. Your case may slip through the cracks, and payroll deductions could continue for months before someone with authority realizes the error.

You can consider filing a "Request to Modify or Stop Child Support" with the same superior court that issued the child support order. Use the identical case caption (including case number) that was used by the court when it entered that order, and make sure that you send copies of your request to *every* interested party or attorney who participated in the original case. You might also want to contact the clearinghouse or garnishing agency directly, and notify it of the fact that your children have turned 18 and graduated from high school.
