Question: I am pregnant with my first child. the father wants nothing to do with they baby. I want to file for child support but do ihave to have the baby before i start to recieve the child support?

Answer: This is for informational purposes. An attorney should be consulted for specific case questions. The Arizona Revised Statutes provide for general presumptions about parenting and Child support. The First, A.R.S. 25-814(C) http://www.azleg.gov/ars/25/00814.htm provides a general presumption that a man is the father of a child if he and the mother were married any time within 10 months prior to the child birth or the child is born within 10 months after the marriage has legally terminated. Secondly, A.R.S. Section 25-501 provides the following, “every person has the duty to provide all reasonable support for that person's natural and adopted minor, un-emancipated children, regardless of the presence or residence of the child in this state.” For a determination on how these and other statues may apply, and attorney should be consulted.
