Child Support
questions & answers
Question: Can my son withhold child support payments because the mother of his child refuses to let him see him because he won't apologize to her !
Answer: The following is provided for general information only. To find out how the law applies to a specific situation, contact an attorney directly (http://www.azlawhelp.org/articles_info.cfm?mc=5&sc=36&articleid=151). It is unlikely that one parent can legally withhold child support because he or she is refused parenting time with the child by the other parent. Child custody, parenting time, support are separate responsibilities. Refer to the Child Support Article (http://www.azlawhelp.org/articles_info.cfm?mc=1&sc=2&articleid=53) and the Child Custody Article (http://www.azlawhelp.org/articles_info.cfm?mc=1&sc=1&articleid=68) on this site for a helpful explanation of child support and child custody. In the absence of court-ordered child support, custody or parenting time, a parent can make such a request to the court. Visit www.AZLawHelp.org. In the window frame located on the right side of the page, look for the Find Free Legal Help section. Select the appropriate county and the search results will show a list of organizations that provide legal assistance. Also, depending income level, the Arizona Foundation for Legal Services & Education (http://www.azflse.org/azflse/about/contactus.cfm) may be able to assist by providing a list of attorneys that provide legal assistance for free or reduced rate.
