Question: I pay child support in Arizona. Can the custodial parent receiving the support moved to another state?

Answer: The following is provided for general information only. To find out how the law applies to a specific situation, please contact an attorney directly. According to ARS 25-408 A , at least sixty days advance written notice shall be provided to the other parent before a parent may relocate a child outside of the state or relocate the child more than one hundred miles within the state of Arizona. Section C of this statute provides that the nonmoving parent may petition the court to prevent the relocation of the child within thirty days after receiving notice. Furthermore, according to Section G, if there is a parenting plan in place, “the court shall not deviate from a provision of any parenting plan or other written agreement by which the parents specifically have agreed to allow or prohibit relocation of the child unless the court finds that the provision is no longer in the child's best interests.” To locate the appropriate forms to petition the court, please contact the local courthouse or visit their website.
