Question: 1.Can child support arrears be not garnished every week? In other words, can child support arrears be distributed once a month? 2. Can child support arrears be garnished less than the court ordered amount?
Answer:
It is best to contact the Department of Economic Security for information on the frequency and methods of making court-ordered child support payments. Per the Payments FAQ’s Page (https://www.azdes.gov/az_child_support/paying_modifying.aspx), you may request your existing payment plan be altered: “both custodial and non-custodial parents can request a modification of their existing child support order when there has been a significant and continuing change within the household, such as adding or changing health insurance, a loss of a job, disability, or an increase or decrease in income for either parent.” This page includes a link to the form to request this modification.
