Question: I recently fieled Oder of protection against my exhusbands new wife. My children go to the school where she works. This makes it so I can not go to the house or thiere school to pick up my children on my days to get them. My ex will not meet me anywhere for me to get my children. What do I do, what are my options?

Answer:

If you acquired a protective order against your ex-husband's new wife, and she did not also secure one against you, then you are under no legal restriction at all. This is a common misunderstanding.

A lot of people think that, once they get a protective order or harassment injunction against Person B, then they are not allowed to contact Person B any more than Person B can contact them. That is not true. You should use good judgment, of course, and not deliberately instigate unnecessary confrontations with this woman. But unless you are subject to some other court order prohibiting your presence at the school, you should be able to retrieve your children from the school just like always.
