Question: What if mother of children is not letting father see the kids , then says father didn't excersise his parental rights ?

Answer: Parenting rights and visitation are governed by Arizona Statute.  Arizona Revised Statutes, sections 25-403 to 25-408.  The statutes give you the right to petition the court for additional visitation time or for a change of custody.  If you cannot afford a lawyer to assist you, you can visit the self-help center on the website for the Superior Court of Arizona.  There, in the family law section, you will find forms and instructions to help you petition for visitation.  You may also want to sit down with a lawyer for an inexpensive consultation to help you decide the best course of action.  There are 3 programs in Arizona that you can use to get some inexpensive legal advice and guidance.  One is the Modest Means Program.  For a $75.00 fee, the Modest Means Program will arrange a one hour consult with an experienced attorney.  The telephone number is (866) 637-5341. Both the Maricopa County Bar Association and the Pima County Bar Association have lawyer referral services that offer a 30 minute consult with an experienced attorney.  Maricopa County's Lawyer Referral Service offers a 30 minute consultation for a fee of $40.00.
