Question: MY DAUGHTER DIVORCED A MAN AFTER HAVING 2 CHILDREN. NOW HE SAYS THAT HE HAS 3OF 4 WEEKEND VISITATION WITH THE GIRLS OR 1 WHOLE WEEK WITH THEM. IS THIS TRUE?
Answer: A person cannot make modifications of child custody outside of the court’s approval. In order to create of modify a parenting plan/legal custody order, a parent must file specific petitions with the court. If the court grants these petitions, the parent then has his/her desired legal custody plan. Visitation rights must also be approved by the court and are not up to the parent to create a binding schedule.
