Question: hello there i am in need of big help anything would be great help i have a no contact order with my boyfriend and we had one week moment and i am now pregnant i am scared that the judge will ask me to take a dna test to see if he is the dad can i refuse to take it thank u so much for taking the time to help me out

The court will automatically enter for paternity of the respondent father, if he fails to appear without cause to the summons of the court or refuses or fails to take a DNA test. A.R.S. 25-813.

Paternity can be determined by the evidence presented in court, including genetic testing of the alleged father, mother and child. All parties in a contested paternity case must submit to genetic testing at the request of either party.

Unwed parents may voluntarily acknowledge a child without DNA testing until the child reaches the age of 18. Unwed parents may also walk into any Child support office to complete an Affidavit Acknowledging Paternity (AOP) form to voluntarily acknowledge paternity. A.R.S. 25-812.

Generally, the person to petition the court for DNA Paternity actions will be the mother, the father or the guardian of a child or children born out of wedlock. A.R.S. 25-803.
