Question: Ny childs father's name is not on the birth certificate, can he still file for custody
Answer: Chapter 4 of Title 25 of the Arizona Revised Statutes deals with issues of custody. The statute talks about who can establish custody and determining paternity of the child. A.R.S. 25-803 discusses who may originate proceedings. Section C of the statute states, “Any party to a proceeding under this article other than the state may request that custody and specific parenting time be determined as a part of the proceeding. When paternity is established the court may award custody and parenting time as provided in section 25-408. The attorney general or county attorney shall not seek or defend any ancillary matters such as custody or parenting time.”
