Question: My daughters mom and I have 50/50 joint custody but she passed away in June. What do I need to do in order to get full custody of my daughter?
Answer: The surviving parent generally has full custody. However, a stepparent can file papers with the court requesting custody or visitation. If you have concerns that someone else will seek custody, you have the option to file a notice of the other parent's death in family court with a copy of the death certificate and request that the court issue an order granting you sole legal decision-making and parenting time.
