Child Custody

questions & answers

Question: The father of my children wont let me see my kids and there is no court order or anything for him todo this to me i just want to know what do i do to help me see my kids i have done nothing for him to keep from me i just need advice on how to see my own kids?

Answer: Unless there is a court order to the contrary, the courts presume that both parents have equal rights to custody and legal decision making for their children.  If your ex has physical custody of the children and refuses to allow you visitation, you will need to take legal action to enforce your rights.  Arizona Revised Statutes, Section 25-401 through 25-408 deal with custody and visitation.  The Arizon Superior Court's website contains a self-help center with forms you can download to file an action for custody (now called legal decision making) and visitation.  Your best option, however, is to consult a lawyer.  The Lawyer Referral Service can provide you with a half hour consultation with an experienced attorney who can advise you on your problem.  The service charges $40.00 for the consultation.
