Question: I am not married but have been dating and living with my boyfriend in his moms basement. We got in a fight and I wanted to leave but he refused to allow me to take the baby. What do I do legally to get temp custody until we figure out custody??
Answer:
To obtain temporary custody you will need to file a motion for Temporary Orders. Temporary Orders for custody (known as legal decision making in Arizona) can be filed at the same time or after the Petition to Establish Legal Decision Making, Parenting Time and Support. Court forms are available at the Superior Court in the county where you reside.
