Question: my husband and I are separated with 2 children. the oldest (almost 18 with a full time job) is living with him on the east coast. our youngest lives with me. we agreed to this arrangement. how do we go about a divorce with this living arrangement?

Answer: To file for a divorce in Arizona, you or your spouse (or both) must live in Arizona for at least 90 days prior to filing with the court. If you are asking the court to make decisions about child custody, you must have lived here for 6 months. When you file these forms, you can submit a written agreement between you and your spouse regarding the child custody arrangements. During the proceedings the court will recognize and finalize agreements relating to custody of the children.
