Child Custody

questions & answers

Question: My ex is married now and his wife refuses to abide by the parenting agreement we made in court. Does she legally have to abide by the parenting agreement?

Answer: The following is provided for general information only and should not be construed as legal advice. To find out how the law applies to your specific situation, you may consider consulting an attorney directly. The parenting agreement made must be followed by both parents and her involvement may result in a violation of the agreement. If so, the court can be petitioned for help by filing a written request for enforcement with the Clerk of the Superior Court and paying a filing fee. A hearing may be necessary if the matter cannot be resolved. State law requires that the court act quickly upon a request for help in enforcing a parenting time order. There are several remedies that the court can use to enforce the parenting agreement. Read more about them at A.R.S. 25-414.
