Child Custody
questions & answers
Question: I have a court date coming up in a few days for a petition for Emergency custody my wife has asked her attorney for. I am looking for a paid attorney for myself, I think I have found one but she wont be able to do so for about a week or two, so she said to request the courts grant a continuance to give her time to prep for my defense. I am wondering how I can go about requesting this without a lawyer present? Will the judge be able to do this?
Answer: The following is provided for general information only. To find out how the law applies to a specific situation, contact an attorney directly. The forms to a file for temporary emergency modification of custody without advanced notification to the other party can be found on the Superior Court Website. To locate the closest Superior Court use the Courts Locator. The Maricopa County Superior Court lists requirements for obtaining emergency modification of custody. Please refer to their website for these requirements and for forms needed to file for emergency modification of custody and/or parenting time. For additional information please refer to the Superior Court directly. Since Family Law issues can be very fact specific and are often complicated, you may want to consult with your attorney for specific legal advice.
