Child Custody

questions & answers

Question: I am pursuing custody of my 9 year old son and was told I should try and get a Guardian ad litem but I can't find anything about what is required to request one, or what guidelines the court follows in granting one. What do I need to do this?

Answer:

The following is provided for informational purposes only. To find out how the law applies to a specific situation, contact an attorney directly.
An individual can petition the Court for his or her child to be assigned a best interest attorney (guardian ad litem). The party requesting a guardian ad litem would submit a blank motion to the Clerk of the court with the request included in the motion. Contact the Clerk of the Court where the case is occuring to find out the local rules and requirements for requesting a guardian ad litem. To find a local court, use the Arizona Supreme Court, court locator. To find out how the law applies to a specific situation, or to get legal advice, contact an attorney directly.
