Divorce & Annulment

questions & answers

Question: Wife left three years ago. No legal separation or divorce. We verbally agreed on money and custody. I bought her out of joint house and own it myself. She now demands money for medical for son. I give her willingly 120 a month. She wants more. Can she sue me?

Answer: She has the right to go to court and file a petition for dissolution of marriage (divorce) and ask for child support and that you provide medical insurance for the child. She may or may not do that.  If she does go to court, the court will use the child support guidelines to determine how much your monthly support will be.  They compare your income and hers to determine support.  $120 per month is a very low amount for child support generally.  If you want to look at the guidelines and figure out a ball park figure for what you would owe, go to  https://www.azcourts.gov/selfservicecenter/Family-Law-Forms.
