Question: I've been married for over 7 years I did an annulment but Tucson courts are saying its invalid because we have been married longer then 90 days and I was supposed to do a dirvoce not an annulment. Need someone to let me know if I am legally annulled or do I need to reapply and do a divorce.
Answer: Your question is unclear on several points. Was your annulment granted by an Arizona court? In Arizona, a marriage can be annulled only if it was an illegal marriage in the first place. Arizona Revised Statutes, Section 25-301. For example: marriages between close family members are not legal; marriages involving a minor who marries without parental consent are not legal; neither are coerced marriages. (Arizona Revised Statutes, Sections 25-101 and 25-102) A voluntary, consensual marriage between two unrelated adults can be dissolved only by divorce -- even if the marriage lasted for a couple of days. Unless an Arizona Court found that you had entered into an illegal marriage and had the proper grounds for annulment, Arizona law will require you to file for divorce from your spouse. Many people have the idea that a very brief marriage can be dissolved by annulment. However, that is not Arizona law.
