Question: If a couple married for 14 years and live in the same house in case of divorce who owns the house if the house was bought before the marriage by one of the spouse?
Answer: Generally, A.R.S. § 25-213 states property bought before marriage is the separate property of the spouse who purchased the property and is not community property. However there are many exceptions to this rule, and it may be in your best interest to consult an attorney to determine whether the home is community property or not.
