Question: Recently, I have been put under a the protection of a restraining order with out my consent. It lasts one year and I do not wish to remain under it for that long. I'm going to turn 18 in a few months. Is it possible to take the protection of the restraining order off of me when I turn 18?
Answer: According to the Maricopa Superior Court: A plaintiff may request that an Order of Protection be dismissed or quashed at any time during the term of the order. Only a judge can dismiss an Order of Protection.
To file a motion to dismiss or quash an order of protection, you must go to one of the Protective Order Centers(https://www.superiorcourt.maricopa.gov/MediaRelationsDepartment/docs/brochures/Protective_Order_Brochure.pdf) to complete a motion. You will be required to provide identification to court personnel at the time you complete the Motion to Dismiss or Quash. You will be required to appear before a judge and explain why you want to dismiss the order. Please allow at least two hours for entire process.
