Question: My boyfriend and I been in relationship since 2009 we has 1 kid and she is 20 months. My boyfriend passed away just last week. I know still and grief but thinking about my daughter future made me to act ASAP I think I need to take care of my daughter's inheritance. Because I don’t feel my boyfriend family is like us. I want to know if this is possible will happen the following question: 1 – Can I open or intervene in probate of my boyfriend's estate? 2 – Can I file a child support from my boyfriend estate? 3 - Do I might need to file a claim as a creditor?

Answer: You may need to contact an Estate attorney to find out what rights your daughter has to her father's estate. There are many factors here that need to be looked at. If father was on the birth certificate, she may be eligible for Social Security benefits. You cannot report a death or apply for survivors’ benefits online. If you need to report a death, contact your local Social Security office or call 1-800-772-1213 ( TTY 1-800-325-0778). You can speak to a Social Security representative between 7 AM and 7 PM Monday through Friday.
