Question: Am I allowed to take my children on vacation out of state or do I need to ask the court?

Answer: Assuming that you and your children’s father share joint custody and decision making, and the both of you reside in Arizona State, you must give 60 days’ advanced written notice to the other parent before relocating the child out of state or within 100 miles within the state ARS 25-408. When considering relocation, the judge presiding over the matter will rule in the child’s best interest. As far as vacationing goes regarding your children, there are not any state statues regarding the matter.
