Question: how do i stop father convicted of attempted molestation,currently still incarcerated,from getting visits or any sort of custody,or involvement in legaldecision making? he has filed an appeal of default case. and can i remarry while its in an appel? I live in Az.

Answer: When the court considers awarding sole legal custody and sole legal decision making vs joint, it takes several factors into account. 1: The agreement or lack of agreement of both parents 2: Whether a parent's lack of agreement is unreasonable and influenced by something other than the child's best interest. 3. The past, present and future abilities of the child to cooperate in decision making about the child. (ARS 25-403) If it is in the child's best interest to award sole custody to a particular parent, it is likely that the court will oblige. If somebody is legally divorced, they are able to remarry at any time, even if the custody of a child is in contention.
