  • My father died in March & mother in June. We have found that dad had some life insurance through USPO with no beneficiary designated. They want to pay to my mom's estate but there is no estate. She had assets under $10,000 and no real property. I found the small estate affidavit. There are three surviving children, 1 deceased with 2 children. I assume we all need to fill out an affidavit? One of the grandchildren is still a minor. Who fills out his?
  • I recently moved into a condo and i signed a lease and she accepted payment and I moved in. Then a few days later she came to me and told me I need to get out because she had found out about an old landlord who gave me a bad review. I didnt lie on my application i gave her two years back even thou she asked for five. she didnt say anything about it and approved my application. Does she have any right to evict me?
  • Currently my home is not in foreclosure. I am behind in payments and the bank will not allow me to make partials. They are willing to reinstate the loan but I am unable to raise the 6 payments required. I have received default and letters of intent to accelerate. The bank is recommending a short sale. I want to work this out and I have saved 3 payments and I wish to stay in the home. We received a modification in 2012 and a special forbearance in 2013 I am back to work after being laid off in September and emergency surgery in December. Do I claim bankruptcy in order to save my home?
  • I was served my notices and went to court with my landlord. She got a judgement against me for unpaid rent and was granted a writ of restitution to be received on 9-1-09. On the morning of 9-1-09 when I returned to the property to finish moving, she had locked the gates. My dogs were still there and I had not been served the writ by the constable. Turns out that she did not received the writ until 10:18 that morning but the gates were locked at 8:48 a.m. Does the writ have to be served or is it just given to the landlord and they can do as they please?
  • I started Beauty School in Sept 07, I was 17 at the time.The school had me sign for the loan without a co-signer. My parents filled out the paper for the Pell Grant and wanted to pay so much monthly. The school said I had to have a Subsidized Stafford loan to get the Pell Grant.Am I responsible for the loan? Since I was told afterwards that it was not a legal binding contract due to my age and that neither one of my parents co-signed on it?
  • I have received a notice to move in 30 days...actually it is only 28 days as they did not figure Feb being a short month...is this legal? They want me to move in the middle of the month...my lease is up in 9/15 - they have given me no reason. Is this legal? Can they evict me? What can I do to stop this? I plan to move before my lease is up anyway.

There is a large Tree in the back yard, over 30 ft tall, that has been maintained by the previous owner personally and by some people the property management sent over three different times since taking over the property. Due to a recent storm, the tree has broken branches 20 + feet in the air. The property management company was notified and have told me its my responsibilty. Is this true or not?
