Horne Issues National Mortgage Settlement Consumer Alert to Arizonans

PHOENIX (Tuesday, April 24, 2012)  --  As the National Mortgage Settlement between Arizona and 48 other states, the federal government, and the country’s five largest residential mortgage loan servicers goes into effect, Arizona Attorney General Tom Horne is alerting Arizona consumers looking for mortgage relief to beware of scam artists.

“Consumers should be aware that scammers are already using the media coverage of the settlement to exploit homeowners by promising quicker assistance in obtaining the refinancing, principal reduction, or cash payments available to eligible consumers under the settlement,” Horne said. “If you receive an unsolicited contact regarding the mortgage settlement, you need to protect yourself.”

Attorney General Horne’s alert includes these tips:   

  • Beware of anyone who claims they can speed up the assistance you might be eligible for under the settlement for a fee.  You will not be charged a fee to obtain relief under the settlement.
  • Beware of anyone who calls claiming to be from your mortgage servicer or the government and asks to confirm personal or financial information to speed up your relief under the settlement.  Neither your bank nor the government will ever ask for your routing number, checking account number, or other financial information over the phone.
  • You may receive legitimate mail from your servicer regarding the settlement if your mortgage loan is serviced by Bank of America, JP Morgan Chase, Wells Fargo, Citi, or GMAC/Ally.  If you do receive a call or mail regarding the settlement, examine it closely to determine whether it is from the same entity you make your mortgage payments to.  Scammers often use company names very close to another company to confuse and deceive consumers.  (For example, instead of a letter from GMAC, you may receive a letter from GAMC).
  • If you are unsure whether a caller is legitimate, ask for the person's name and title and tell them you are going to call your bank and confirm.  Make sure to use the official contact information listed below, not a number the caller provides.

  • If you are looking to refinance or get a loan modification, remember that it is against state and federal law to charge upfront fees for mortgage-related assistance in most cases.

  • I have a ten year maintenance agreement with XXXXX, Inc dated 4/22/2016, for a twice a year maintenance service on my air conditioner / furnace which they installed for my home. I paid $1600.00 for this service. (This comes to $80.00 per service) and I received five services. When the sixth service was due (April 2019) I called for an appointment and their phone is shut off. I called their offices in Tucson, Pheonix and Glendale, all their phones have been shut off and the Tucson office is locked. I can't find anyone and they still owe me $1200.00 and I don't know what to do.
  • I purchased an ET center from a local store. I signed a paper that said no refunds and exchanges are per their approval. I asked them to place this furniture on hold for a least a month as our home was being rebuilt from a fire. Twelve days later I called them and advised I no longer wanted the furniture and they have refused to credit my credit card due to the paper I signed. Is this legal for them to say no refunds on furniture I never got?

I had problems with the Key, brought it to the dealership, they told me since I had a after market alarm installed (Over a year ago, that never caused problems to the vehicle) It voided my warrenty. They never gave me any kind of proof showing that my alarm was the cause of the problem. I then had to pay out of pocket and feel scammed. Does aftermarket stuff void warrenties?
  • A nurse friend of mine thought she was signing up for a BSN program with excelsior college through The College Network(TNC)but was never contacted even though they have taken out monies every month, approx. $600, when she called TNC said she could not withdraw and must pay the full amount. The physical transaction occurred in Maricopa County, however the negotiations occurred over the internet. Can I file the claim in Maricopa County small claims court and have him served in Pinal County, or do I have to file in the county where he lives?

  • An insurance company contacted us and informed us that our father purchased us whole life policies the year of our birth. He is not alive so we have no information on these policies. The insurance company claims that both my brother's and my policies have had two loans issued against them on the same date. They cannot provide us any documents to prove the loans that have over the last 30+ years have increased for interest and penalties to over $8500 on each policy. It is my understanding that an active contract requires documents associated must be kept. Would that be accurate?
