Question: I am in probate I hga ve a title that is in my maiden name and my deceased mother had a lien on it with the department of dmv probate said I had to get legal advice how to lift this lien off this title because she has to no the lien amount because its taxable but dmv said they don't require a amont on lien can someone help me please what do I need to do

Answer: Presumably, this asset has become part of a Probate Court case by co-ownership/joint title with the decedent. For a car title, if the “lien” is for a car loan, the DMV should know and give you the name of lender who placed the lien. You can then contact the lender for how much is owed. If this is not a car title, begin by requesting from the probate court a printed document containing everything they DO know about the “lien” (encumbrance) against your asset. Incidentally, the probate court does not deal with “tax” issues--only assets and debts of the decedent.
