QUESTIONS

  • My employee quit without giving required two weeks notice. In contract that he signed, it says specifically that if he quits without notice, I as an employer have a right to deduct from his final paycheck any costs incurred by his resignation. Employee agreed to this and signed the contract, but now he demands full payment. Can I reduce his pay? I had to cover his work by hiring a replacement
  • Is rent late if mailed on due date and lanlords live in another state
  • My landlord called me and told me he will be selling the home I am living in. He has not put that in writing. He said he gives me 2 months to move out. Do I have to continue to pay the rent while I am living there?
  • If an undesignated felony 6 is dropped to a misdemeanor; is that person still considered a felon? Are they still required to report a felony conviction or can they legally state they are not a felon? What are the benefits of getting a felony dropped to a misdemeanor? I understand the expungement and set aside concepts but if a background check still shows a felony even though it was dropped to a misdemeanor and set aside what do we have to do to get it to show accurately and display the conviction as a misdemeanor? Whats the point if getting it dropped and set aside if it shows a felony?
  • I was contacted by the Sheriffs dept. and told an Order of Protection was served to me the past April. I was never served any documents or aware of this. How may I get a record (copy) of this service?
  • I got granted temporary sole legal decision making of my daughter but during this case I got into a car accident with my other daughter, I was not the driver or passenger and had no illegal part in this accident. Now my daughters father is telling me he has temporary sole custody and I cannot see her at all. He has domestic violence and was told that sole custody was not an option in our case for him. He got a lawyer and we made a settlement so it would be easier for me because the accident ruined everything with my life and I signed it but she told us that we needed to get it notarized.
  • Are corectional officers required to keep records of all conflicts and injuries within the facility? What happens if they loose a piece of evidance? What if this seems to be done on purpose?
  • My mother rented a place on a month to month basis, signed a lease, paid a $600 deposit, and was asked to give a 30 day notice when she planned to move out. She moved in 11/1/2017. On 11/14 she went to the ER and was admitted to the hospital because we found out she had a spinal cord tumor. On 11/20 she transferred to inpatient Hospice and died there on 11/22. Her things were moved out and the place was immaculately cleaned on 11/26. Her landlady knew she wouldn't be returning as early as 11/18. Is she obligated to return the full $600 deposit even though a 30 day notice wasn't given?
  • How do I know if my employer is violating laws against blocking me from serving jury duty? They have paid jury duty time but will not let me take it without extending my contract, a highly undesirable result and something I perceive to be retaliation. Should I obtain counsel for this or am I being overdramatic? Thank you!
  • I received a letter from an attorneys office stating that the home I am renting has been forclosed on.  How long do I have before being evicted? How do I recoup my deposit if I do not withold rent?
