Question: My boyfriend was arrested last night for aggravated assault against me. I told the police that he has a history of mental illness and that he needed to go to a psychiatric hospital but they took him to jail anyway. I am not pressing charges but I am afraid the state will. How do I help him get the charge dropped and get mental help?
Answer: In Arizona, it is the state that presses charges against someone for aggravated assault. There is Mental Health court in Maricopa and Pima Counties. Go to here to learn more about the Mental Health court and how it works. The court judge, prosecutor and defense work together to give the person options for treatment versus jail. You may need to request the courts to transfer the case to Mental Health Court. You may also want to see an attorney for more information.
