Question: Can I get full custody and child support from kids dad. We moved here to Arizona 3 years ago and he hasn’t helped with anything but medical coverage. We had 50/50 but really needing his help raise his kids
Answer: You do not say if your ex also lives in Arizona, nor do you say whether your custody order was issued in Arizona Court or in the state where you previously lived. It makes a difference. If the custody order was issued in another state, that state continues to have jurisdiction until you take action to change it. If you moved here without him and you have the children full time, you have the right to file a motion with the court requesting child support. You may find it helpful to at least talk with a lawyer about the specifics of your situation. Take a copy of your custody documents to the meeting. There are three programs in Arizona that you can use to get inexpensive legal advice and guidance. One is the modest means program. You will need to apply for the program and meet the financial qualifications. Once you are qualified, Modest Means will send you a list of attorneys whose practice covers your area of concern. You select a lawyer from the list and will be entitled to a one hour consultation for $75.
