Question: What steps do I need to take for filling full custody of my child when we both have joint custody

Answer: To file for full custody when joint custody exists, a Petition to Modify Legal Decision Making (Custody), Parenting Time and Support, and several other documents must be filed at the Superior Court in the county where the original order was given. Then you must serve the other party with a copy of the petition and the other documents.

Once all of the forms are filed, the other party is served, the judge will either approve or deny a hearing in which the judge will make a determination whether or not to modify the order based on the best interests of the child.
