  • I have leased to a tenant in Surprise. I had the front and backyard cleaned for the tenant when she moved in. Now the tenant is refusing the maintain the front and backyards. Who is responsible for landscaping to HOA specs?
  • I sent my tenant a 5 day late notice via certified mail and it came back to me unaccepted. It's obvious he hiding. What do I do now?
  • My landlord turned off the heat to the entire apt complex a week ago, and stated that it can't be turned back on. It is reasonable to presume that without heat, the temperature inside the residing units will be comparable to outside. I tried to submit, in writing, a letter requesting that by purchasing an adequate heater to heat my unit during this time, I may apply the amount spent on the heater, with proof of receipt, to be deducted from my rent for the month of March, 2015. I cited 33-1324 and 33-1364 in the letter. The landlord denied the request. How enforceable is my principle?

(It was a month to month lease but right after I gave my 30 days she found a new tenant so she owes me for 90% of the month as well) In her lease contract she wrote that she has 30 days to return deposit, however that goes against the state law. Will I have to wait 30 days or does State Law trump a lease contract?
  • My property management company called me yesterday and informed me that I need to go to court for an eviction today.? I NEVER received any summon in the mail and was never severed. I made a partial payment($600 as opposed to the 668 rent amount) via our tenant portal last Friday with a prepaid debit card. My property management company told me yesterday that it hasn t posted even tho I confirmed with the prepaid company yesterday and the tenant portal shows it s cleared. Will a judge grant the eviction?
