my husband left me and my children, he is the father of our 6 yo daughter. He has been gone almost 2 months, and has not helped out financially at all. My question is, in the event of my death or incapacities, how do I grant my parents legal custody of my daughter. I am wondering if I can type a letter and have it notarized since we have not started divorce proceedings at this point in time. I just want to make sure my parents get my children in case of tragedy.

I have been seoerated from my husband for the last 8 week. He told me to take my two boy age 6 & 8 and move to my sisters in Nevada. I have both boys in school here and have a new job . befor my paper were filed with the Nevada. He filed in AZ. I was served today with paper stating I must return the children to Flagstaff. My ex boyfriend put a restraining order against me so I couldn't get my things from his apt. separated after restraining order for a few weeks he has made contact with me the whole time (calls to myself and friends and family, text, showing up where I moved to). Me and my girlfriend are asian. Currently I am working in US by holding my non immigrant visa and she is staying in Asia. We are planning to get marry soon. My grandson is 5 and has spent most of his life in my custody. He states he hates going home because there isn't any food or the electricity is turned off. Mom has since had 3 other children, and the father is threatening to take them. My concern is he is being neglected. She can't keep a home, she's very transient, can't keep a job, and has a house of women who berate and verbally abuse my grandson. With me, he has consistency and structure. Every now and then mom wants him back, but it's only briefly. Is there any way for me to get guardianship I worry so much for him?
