The father of my children had sole custody, and he committed suicide. I am wondering if I need to file for custody or if it automatically reverts to the mother. The children are with me, and have been since the incident. i have the death certificate and have filed at the social security office. I just feel funny not having anything that says I have custody. Should I file a modification or is it a waste of time?

If an order of protection is obtained, and an appeal was rejected. In the even the order is then modified and granted with the modification, does the order of protection get extended? For example: original order granted 11/12/2015, but was modified and granted 2/2/2016 is the new date 2/2/2016 or does remain the date of the original service?

I have a 9 year old child and share custody with her monther from whom I am divorced. I am now applying for social security benefits and have learned that my child is eligible for benefits. Since I have my daughter almost 50% of the time and maintain a residence where she has a separate room, clothing and articles, would the benefit paid to the child go to the mother? I don't feel this is fair since I am responsible for her medical expenses, child support, etc. Can you please advise.

I have a question regarding medical insurance. When we were divorced 11 years ago my ex husband was ordered to carry the medical insurance on our son. He was fired from his job about a year ago and found something else that did not have medical insurance so he applied for a "discount" medical card. I have since put our son on my medical insurance to make sure that he has the best coverage. Is there any way to have him pay the premium?

I have been listed as custodial parent for our daughter since our divorce in 2010. At the time of divorce my ex husband wasn't employed but it was listed in the decree that he was to pay 100% for all health insurances including dental and vision and was responsible for 50% of all non covered medical expenses as well. From Jan 2011-March 2018 he failed to pay any of these obligations. We have a court ordered child support in place now but his self employed income hasn't been filed according to his then attorney since 2016. How will the court determine his income?
