Question: I am being evicted under section 33-1368a unauthorized guest.a friend of mine came by to say hi and to get a cold drink. As my friend was arriving my landlord and my friend had words with each other one calling the other a racist for commenting on baggy clothes. I was served with a written 13-3368a notice and was told he couldn't come back. About 3weeks later my friend showed up again I told him he wasn't allowed on the property gave him some water and he left. The next day I was served with a second 33-1368a notice with 10 days to vacate the property. Is this legal and what should I do?

Answer: If a tenant violates the community rules or disturbs other tenants, the landlord may serve the tenant with notice of the rules that were violated and instruction to fix the behavior.  After the tenant has been served notice, if the rule is violated again the landlord may file with the court for eviction.  Technically, a settlement can still be made at any point before the court officially makes a ruling.  In the event that the tenant and landlord come to a settlement, it should be documented for future reference.
