Question: I am a property/apartment owner I recently had my onsite property manager show a vacant apt. to some interested people shortly after they people looked at the apt they without any application or lease somehow moved thier belongings into the apt have paid no money no lease signing etc. and are participating in criminal behavior etc. but are refusing to leave the apt I live out of state but property manager has on several occasions tried to contact these people telling them to leave etc. but they so far refuse what do I do to get these people out of this apartment?

Answer: You may want to review A.R.S. §§ 13-1502-13-1504 to see what constitutes a "criminal trespass." Additionally, you may want to contact local law enforcement if you feel that this constitutes a criminal trespass. If you are told it is "civil" you may also want to review A.R.S. § 12-1171 and 12-1172 regarding "forcible entry." Forcible entry and detainer proceedings can be found in title 12, beginning with A.R.S. § 12-1171.
