QUESTIONS

  • My mother passed away. She does have a will and I was nominated as the executer and trustee. I am the sole beneficiary. She only has a bank account but when the account was setup nobody was on the account but her. no payable unpon death. What is required by the bank for me to access the account to begin paying for her expences? Her will did state that I shoud have immediate access without going through the courts.
  • I received a request for paternity for my son we took the test i havnt received the results but the state has and now wheni took up my case it says they scheduled an establishment hearing what does that mean?
  • who do i make the actual check im sending to the child support clearinghouse out to? my ex-wife? the clearinghouse itself? the court?
  • Are landlords responsible for termites/ swarmers in apartment complex!? Lease states they cover “pest control but excluding “wood eating insects” and they are not responsible for any damage to my property because of them... !? That cant be legal. Its like living outside with all these flying termites.

  • My mom's 3rd husband is calling and demanding visitation. He abuses my mom and she worships him. He says that he just paid $100,000 on a house so he should have no problem suing us for visitation. I am afraid he has an inappropriate interest in my daughter. They've only seen her 2x's in her life, btw & my mom never even held her. They are both drug addicts & now they have the money & time to come after us. Any advice would be great!
  • I own a property, not my main residence, that was part of a 2010 C7 bankruptcy. We reaffirmed and kept the property. We have made all of the payments since, but in the past year our finances have declined. We have tried to rent the property without much success and we have paid over $6000 above the properties income to maintain it. It is empty again and we simply cannot continue to pay the mortgage and HOA any more. It is worth about what I owe. Can I allow the property to go to foreclosure or short sale after being part of a bankruptcy?
  • C Our neighbor upstairs has caused us problems about the parking and has threatened my 70 yr old husband and myself. Last Friday his gun "went off " into the floor of our bedroom, where my granddaughter and I were. He went to jail. No one was hurt. But I do not feel safe with all that and then yesterday a person was arrested in front of our apt with a large amt of money and drugs. He went to jail also. Our lease is up but we had intended to renew. Now I'm afraid to live here. We were supposed to give a 2 months notice if we moved out. Do we still have to give that much notice?

I will continue to keep her things in storage until she gets out of jail and not charge for that. I'm not asking for back rent or anything, just that she moves.
  • I co-own property in CA. There are 3 of us still living on the title, myself, my brother and 1 other lady. I need to sell at least my portion ASAP, but cannot get the woman to even acknowledge my attempts to contact her. I spoke to her once and she seemed very nice and said she would help in any way. Since then she has not answered any of my calls or letters. My question is, do I need a lawyer to help convince her to co-operate, and if so, do I need to get one in AZ. or CA.? If I don't need a lawyer, can you please tell me where I can get help with this matter. She lives in CA. Thank-you.
