QUESTIONS

  • I am being threatened to vacate the apartment by my landlord, but I have not received written notice. The reason I have been told to vacate is because my landlord believe I have an unauthorized tenant but she has no proof that the person lives with me and is not giving me the ten day notice to add them to the lease and this is low income is this right or can I fight this?
  • My Park charged me a $5 per day late fee on unpaid late fees. Is this legal in Arizona? The park applies any payment made to the amount due, thus guaranteeing that any payment made that is less than the entire amount owed will be subject to late fees for the entire time additional money is owed. I believe there are laws preventing that practice for mortgages but I'm unsure about rentals or leases. Shouldn't payments first be applied toward the monthly rent or lease and then any additional payment be applied to late fees? And isn't it illegal to charge interest or fees on late fees?
  • I have a balloon payment due this November. And I believe my house isn't even worth what I owe at this point. Is someone willing to lend in these cases?   • I was evicted from my home that I own. Not the land. Was evicted because they said I had a unauthorized roommate and when I asked her to leave she called the police on me and said I pushed her. Both where lies. I haven't even been convicted of the crime. Now they say I can't sell my home unless I pay for lot fees that I owe them after the eviction. They refuse to take my money but then say I still have to pay lot fees. Can I sell my home and not pay these fees. She is telling buyers she can refuse to let them move in if I don't pay for the months I was not even living there.

  • I wish to sell my mobile home located in a MH Park. The Owner of the park told me I have to sell it to him under the "Right of First Refusal" Law. I do not want to sell it to him, as he will use it as a rental. He is using this ROFR for personal gains. I have a buyer already. Does he have the right to force me to sell it to him under this ROFR? He has this written in current Rules and Regulations for tenants. He has already obtained two MH’s from owners by using this statement, and is now renting them out. Is this legal?
