QUESTIONS

  • My father recently moved to AZ; however, his Will was written (through an Attorney) while he was living in the state of Washington. Is his Will legal in AZ? Is there anything further he needs to do?
  • I live in a mobile home park with 90 spaces. We own our homes, but pay rent for the lot. The park sold recently to a property management person who lives and works in the L.A. California area. She has not hired a manager to be on the premises.If we have any problems we need to call her telephone number in California. She has a couple who live in the park that she refers maintenance problems to. They have no authority to answer any questions about anything. We have been given a list of rules and regulations, but no one is here to see that they are adhered to. Is a manager required?
  • Does a 20ft x 20ft area of sand filled with animal waste that is potent enough to be smelled 100 ft away count as a violation of implied warranty of habitability? The lease we signed said that we were responsible for the yard after 30 days but the smell is so strong we couldn't figure out where it was coming from until a few days after that time frame.

  • I have 3 children. They live with their mother in Arizona. I live overseas (with military wife). Our next base is in Japan. My childrens mother and I agreed to let the kids come with my wife and I to Japan for 4 years. I have joint custody of my kids. But they live with their mother full time. Do we just need a court order stating they will come with us and their mother agrees? Or do we need to change custody? please help.

  • I moved into a student housing complex where I was matched with 3 roommates. I filled out a questionnaire to match me with roommates where I noted no pets. Upon moving in I discovered my roommates had 2 cats, I have never had an allergy to cats. Within 5 days of moving in I had to go to urgent care where I was diagnosed with Allergies. Now I have to take medication daily to keep the headaches under control. I notified my leasing office and they are not willing to do anything about it. Is there anything I can do? There is nothing in the lease agreement about that.

  • My home went into foreclosure on 09. Tried short sales and bank never agreed on any of the contracts. So they took the house back 8/27/09 and they sold it 10/27/09. I was told by my realtor and the short sale expert the HOA dues owed to stop payment while in short sale. And after the house foreclosed that the HOA's would be absorbed in the sale of the propety. Now a collections agency has attempted to collect again in 13'. What does the law say about this.
