QUESTIONS

  • Is it legal for a landlord to put into our lease a statement that says "If for any reason during the duration of this lease agreement the relationship between Lessor and Lessee is soured, Landlord reserves the right to serve a 30 day written notice to vacate." Isn't this unconscionable? And shouldn't any ability to break a contract be fair to both parties?
  • I have been told that is a mother and father of a child come to an agreement on custody, child support and other issues pertaining to the child that they can write it out sign it notarize it and it is legal and will hold up in court. Is this true?

  • My daughter has a son with her ex-boyfriend. From the beginning the babys father wanted nothing to do with the baby. He wanted my daughter to abort. Now that the baby is 9 months old he always threatens my daugher that he will take her to court for custody. He does not give her money or buys anything for the baby. He always says that since wanted to have the baby she should deal with it herself. He has three other kids with his former wife. My daughter did put him on the baby's birth certificate. He feels forced into taking care of him. What can she do ?
  • We just moved in a month ago to our first apt and we have a pitbull and boxer mix and we disclosed that info on day one. The lady we talked to the first day said it wouldnt be a problem and the just put in boxer for the breed. Fastforward to a day ago we get a notice saying that there was a complaint that we had a pitbull and they are not allowed at my apt complex. I went to the office sayong there was clearly a mistake but no she gave me a ten day notice to get rid of my dog or give 30 days notice of us wanting to move out. I read over the lease agreement and the pet addendum and there is nothing about breed restrictions or pitbulls. Who is in the wrong and where do I stand legally?
  • My mom was diagnosed with dementia and she received a civil summons from a credit card company. Mom only receives social security and has a very small monthly pension which are put into her checking account. She also has a small IRA from her former 401k which she is having to use for daily care services. This will most likely be depleted soon. Given her current state, we are unsure about what to do. Can you provide some direction? I have read they can put a lien on her checking account. Thank you.
  • My neighbor has a defective air conditioner in there back yard,and it is about 100 feet from my patio.the noise from it is about 5 times louder than a normal home air conditioner.This will be the 3rd year we have had to listen to the nerve racking noise which comes from the A/C I have talked to the neighbor but they refuse to repair it.My question is,is this a county matter or a civil matter?Thank you
